These terms govern your use of the Hoops College website, facilities, and programs. Hoops College, LLC (DBA Hoops College — “Hoops College,” “we,” or “us”) is a North Carolina limited liability company. By accessing our website or participating in any Hoops College program, you agree to these terms. If you are enrolling a minor, you represent that you have authority to accept these terms on their behalf.

Members sign a separate Hoops College Membership Agreement at registration. The signed Membership Agreement is the controlling document for members. The summary below describes its key operational terms.

Program Enrollment

Enrollment in any Hoops College program constitutes an agreement to follow program guidelines, schedules, and the code of conduct. Hoops College reserves the right to remove any participant who violates program standards.

Memberships

Hoops College offers term memberships (multi-month) and month-to-month memberships. Membership dues are paid in advance on the monthly anniversary of the initial registration date.

  • Auto-debit: Term memberships and recurring fees are collected via automatic electronic payment (credit card, debit card, or ACH). By providing payment information, you authorize Hoops College to withdraw dues and fees as they come due.
  • 3-day right of rescission: New members may cancel within three days of signing by written notice to [email protected]. Amounts paid are refunded within thirty days, less $50 for facility usage during those three days.
  • 30-day cancellation notice: Members may cancel any membership with at least 30 days' written notice. Partial months are not permitted; a payment will still be due the following month if notice is given on or after the 2nd day of the due date.
  • Freeze policy: Term members may freeze their membership in one-month increments for up to three months per year for $25 per month. Notice must be given via email at least three working days before the next anniversary date. The contract term extends by the number of frozen months.
  • Late and declined-payment fees: $25 fee on payments received more than 5 days past due. $25 fee on each returned check or declined card. Members who are not current may not participate in sessions after 5 days past due.
  • Past-due cancellation: Memberships 30 days past due are cancelled. Early cancellation fees and late fees apply. Delinquent accounts are sent to collections if unpaid 3 months after cancellation. Reinstatement requires payment of dues owed, a $25 reinstatement fee, and the first and last months of the new membership.
  • Right to modify dues: For month-to-month memberships, Hoops College may increase dues at any time.

Training Sessions, Packages, and Intro Offers

Training sessions and packages are paid in advance. Intro offer sessions are non-refundable. Cancellation, refund, and rescheduling rules for non-membership purchases are described in our Refund & Return Policy.

Chargebacks

By entering into a paid agreement with Hoops College, you agree not to file chargeback claims related to that agreement. Disputes should be raised with us directly so we can resolve them.

  • Initiating a chargeback in violation of this clause results in a $100 penalty per chargeback.
  • The client is responsible for all chargeback fees, regardless of whether the chargeback is won or lost.

Facility Use & Availability

Hoops College does not provide an “open gym” facility. Members and athletes may use the facility only during scheduled classes, scheduled events, or by appointment. We reserve the right to change operating hours and class schedules at our discretion without effect on existing agreements.

We may close the facility for seminars, certifications, maintenance, selected holidays, and other reasons at our discretion. If any part of the facility is unavailable for more than five consecutive days (excluding Sundays), other than due to acts of nature, your membership is extended without dues for the same period. If the facility is unavailable for more than fifteen consecutive days (excluding Sundays) for any reason, you may cancel effective the following first of the month; membership fees already paid are not refunded.

Supervision of Children

  • Athletes ages 8 and under must be supervised by a parent or legal guardian at all times, including escort to and from the restroom. Hoops College staff will not escort minors to restrooms or off-premises locations.
  • Athletes ages 9–13 must be escorted into and out of the facility by a parent or guardian.
  • Guests and visitors under age 14 must be supervised by a parent or legal guardian at all times.
  • Athletes should be dropped off no earlier than 10 minutes before the start of their scheduled class and picked up no later than 10 minutes after it ends. Parents or guardians may be charged $10 per incident, per 15 minutes early or late.
  • Hoops College is the sole determiner of whether an athlete may participate in regular classes, based on physical and emotional maturity, ability to safely perform exercises, and ability to follow instructions.

Conduct, Food, Drink, and Substances

  • Smoking is not permitted anywhere in the facility.
  • Alcohol is not permitted anywhere on the premises.
  • Food and drink are allowed only in non-breakable, enclosed containers and must remain in designated areas. Food and drink on or near the court or basketball goals is prohibited at all times.
  • Hoops College assumes no responsibility for lost or stolen articles. Unclaimed lost-and-found items are donated or discarded after 30 days.

Physical Activity Acknowledgment

Basketball training and strength and conditioning are physical activities and involve inherent risk of injury. By enrolling, you acknowledge this risk and confirm that the participant is physically capable of engaging in these activities. We recommend consulting a physician before beginning any new exercise program.

Waiver and Indemnity

Participants and, where applicable, their parents or guardians agree to indemnify and hold harmless Hoops College, its staff, trainers, and affiliates from injuries, illnesses, or expenses arising from participation — particularly where the participant has not disclosed a known medical condition or other information that might affect their ability to participate safely. Media Release

From time to time, Hoops College may photograph or record training sessions for promotional use. For participants under 18, parental consent is required before any minor's name, image, or likeness is used in any public-facing material. Consent may be revoked at any time by contacting us in writing.

Termination

Either party may terminate a program agreement upon fourteen (14) days' advance written notice. If a client terminates, Hoops College retains payments for all unused training sessions or packages. If Hoops College terminates, unused portions of training sessions or packages are refunded. An early-cancellation fee equal to 50% of remaining dues applies to any multi-month contract terminated by the client before its end date.

Governing Law

These terms and any agreement between you and Hoops College are governed by the laws of the State of North Carolina.
