TERMS & CONDITIONS

These terms govern your use of the Hoops College website, facilities, and programs. Hoops College, LLC (DBA Hoops College — “Hoops College,” “we,” or “us”) is a North Carolina limited liability company. By accessing our website or participating in any Hoops College program, you agree to these terms. If you are enrolling a minor, you represent that you have authority to accept these terms on their behalf.

Members sign a separate Hoops College Membership Agreement at registration. The signed Membership Agreement is the controlling document for members. The summary below describes its key operational terms.

Program Enrollment

Enrollment in any Hoops College program constitutes an agreement to follow program guidelines, schedules, and the code of conduct. Hoops College reserves the right to remove any participant who violates program standards.

Memberships

Hoops College offers term memberships (multi-month) and month-to-month memberships. Membership dues are paid in advance on the monthly anniversary of the initial registration date.

• Auto-debit: Term memberships and recurring fees are collected via automatic electronic payment (credit card, debit card, or ACH). By providing payment information, you authorize Hoops College to withdraw dues and fees as they come due.
• 3-business-day cancellation right: New members may cancel until midnight of the third business day after signing by written notice to [email protected]. Amounts paid are refunded as required by North Carolina law.
• Automatic renewal: All memberships automatically renew unless properly canceled. Month-to-month memberships renew monthly. Fixed-term memberships renew for the same term at the then-current rate for that term.
• 30-day cancellation notice: Members may request cancellation with at least 30 days' written notice to [email protected]. Memberships are not prorated for partial billing periods. A cancellation request does not by itself end a fixed-term membership or eliminate amounts already owed.
• Early cancellation of fixed-term memberships: Canceling a fixed-term membership before the end of its term carries an early-cancellation fee of 50% of the remaining contract dues. The membership stays active, and scheduled charges continue, until that fee is paid in full. Once it is paid, remaining scheduled charges for the term are removed.
• Refunds:Membership dues and unused sessions are non-refundable, except where this agreement or North Carolina law requires a refund. Under North Carolina law, a member may be entitled to a refund of at least 90% of the pro rata cost of unused services in cases of death or disability, relocation more than 8 miles from the member's current location and more than 30 miles from our facility, or if Hoops College relocates more than 8 miles or its services are materially impaired.
• Freeze policy: Eligible fixed-term memberships may be frozen in one-month increments for up to three months per year for $25 per month. Requests must be emailed at least three working days before the next billing date. Regular dues are not billed while frozen, and the contract term extends by the number of frozen months.
• Late and declined-payment fees: $25 fee on payments received more than 5 days past due. $25 fee on each returned check or declined card. Members who are not current may not participate in sessions after 5 days past due.
• Past-due cancellation: Memberships 30 days past due may be cancelled. Cancellation for nonpayment does not eliminate amounts already owed, and unpaid balances may be referred to a collection agency.
• Reinstatement: Reinstatement is subject to Hoops College approval and may require payment of all outstanding dues and fees, a $25 reinstatement fee, and the first and last months of membership.
• Changes to dues: For month-to-month memberships, Hoops College may change dues with any notice required by law. Fixed-term dues stay the same for the current term; renewals may be billed at then-current rates.

Training Sessions, Packages, and Intro Offers

Training sessions and packages are paid in advance. Intro offer sessions are non-refundable. Cancellation, refund, and rescheduling rules for non-membership purchases are described in our Refund & Return Policy.

Chargebacks

Please raise billing disputes with us directly so we can resolve them. A chargeback does not cancel a membership or stop future scheduled payments; to cancel, follow the cancellation procedure above.

• If a chargeback is filed on a payment that was properly authorized and owed, the reversed amount remains owed, along with any processing fees Hoops College incurs and a $100 administrative chargeback fee.
• Nothing here prevents you from disputing a charge you genuinely believe is unauthorized, incorrect, or fraudulent.

Facility Use & Availability

Hoops College does not provide an “open gym” facility. Members and athletes may use the facility only during scheduled classes, scheduled events, or by appointment. We reserve the right to change operating hours and class schedules at our discretion without effect on existing agreements.

We may close or restrict the facility for maintenance, repairs, renovations, seminars, certifications, selected holidays, weather, emergencies, special events, and other legitimate business reasons. Closures of seven consecutive days or fewer do not ordinarily result in a membership extension, credit, or refund. For closures longer than seven consecutive days, Hoops College may provide a membership extension, credit, or other reasonable accommodation. Members' statutory rights if services are materially impaired are not affected.

Supervision of Children

• Athletes ages 8 and under must be supervised by a parent or legal guardian at all times, including escort to and from the restroom. Hoops College staff will not escort minors to restrooms or off-premises locations.
• Athletes ages 9–13 must be escorted into and out of the facility by a parent or guardian.
• Guests and visitors under age 14 must be supervised by a parent or legal guardian at all times.
• Athletes should be dropped off no earlier than 10 minutes before the start of their scheduled class and picked up no later than 10 minutes after it ends. Parents or guardians may be charged $10 per incident, per 15 minutes early or late.
• Hoops College is the sole determiner of whether an athlete may participate in regular classes, based on physical and emotional maturity, ability to safely perform exercises, and ability to follow instructions.

Conduct, Food, Drink, and Substances

• Smoking is not permitted anywhere in the facility.
• Alcohol is not permitted anywhere on the premises.
• Food and drink are allowed only in non-breakable, enclosed containers and must remain in designated areas. Food and drink on or near the court or basketball goals is prohibited at all times.
• Hoops College assumes no responsibility for lost or stolen articles. Unclaimed lost-and-found items are donated or discarded after 30 days.

Physical Activity Acknowledgment

Basketball training and strength and conditioning are physical activities and involve inherent risk of injury. By enrolling, you acknowledge this risk and confirm that the participant is physically capable of engaging in these activities. We recommend consulting a physician before beginning any new exercise program.

Waiver and Indemnity

Participants and, where applicable, their parents or guardians agree to indemnify and hold harmless Hoops College, its staff, trainers, and affiliates from injuries, illnesses, or expenses arising from participation — particularly where the participant has not disclosed a known medical condition or other information that might affect their ability to participate safely. Media Release

From time to time, Hoops College may photograph or record training sessions for promotional use. For participants under 18, parental consent is required before any minor's name, image, or likeness is used in any public-facing material. Consent may be revoked at any time by contacting us in writing.

Termination

Either party may terminate a program agreement upon fourteen (14) days' advance written notice. Memberships follow the 30-day cancellation notice and early-cancellation terms above. Termination does not by itself entitle the client to a refund. Payments for unused training sessions, packages, or membership dues are not refunded, except where required by law or where Hoops College chooses to issue a refund at its discretion. Most agreements that are not month-to-month require an early-cancellation fee to terminate before the end of their term. For fixed-term memberships, the fee is 50% of the remaining contract dues, and the agreement stays active until the fee is paid in full.

Governing Law

These terms and any agreement between you and Hoops College are governed by the laws of the State of North Carolina.
